A manufacturing based client recently found that its business was growing significantly and therefore wanted to change the pattern of working hours of its staff in order to meet their customer demand more efficiently. The issue was made more complicated by the fact that some of its employees had recently undergone a TUPE transfer.
We liaised closely with the management to outline the processes and procedures they needed to undertake in order to make the changes without falling foul of legislation, but also without upsetting their staff by disrupting their working schedule. We stressed the importance of communicating to employees why the changes were taking place, the positive impact on the business it would have and encouraging employee engagement in the wider business strategy. We advised the management team on how to manage the consultation, how to deal with any employees who refused the changes and helped identify any risk areas (such as disabilities or part time workers) where regulations to protect these employees needed to be considered. We then provided the necessary paperwork to reflect the changes in their terms and conditions.
